Will of Goose Van Schaick - 1788

In the name of God, Amen. I Goose Van Schaick of the City of Albany Esq. being in a declining state of health but of sound & perfect Mind & Memory praised be Almighty God Do this tenth day of November In the year of our Lord and Christ one thousand seven hundred & Eighty Eight make this my last Will and Testament in manner & form following[:]

First I will that all my just debts be paid

Item I give & Bequeath unto my loving Wife Maria Van Schaick during the time she remains my widow the use income & benefit of my house & lot of Ground in Albany wherein I now live & the lot opposite the same also a lot on the old Fort together with the income & benefit (during the time of her widowhood) of my Land in the Patent of Loonenburgh in the County of Albany & in Claverack in the County of Columbia & full power to Divide my undivided Lands in the above patents. Item, I give unto my wife full power to sell or otherwise dispose of all my Continental & State Bounty Lands which I am in titled to as Colonel of a Regiment of this State in the Service of the United States.

Item, I give & bequeath unto my wife Maria Van Schaick all money Bonds, Notes, Public Securities & debts of every kind to be by her disposed of during the time of her widowhood without the control of any person whatever in such a manner as she shall think best for the purpose of maintaining, Educating & bringing up of my Children.

Item, I give to my wife Maria Van Schaick my Negro man Tom & Negro Wench Bet with her two youngest children together with al the household furniture which she brought with her for her outset.

Item, I give unto my daughter Alida Van Schaick my Negro girl named Flora & two hundred pounds of public Securities commonly called Banckers Notes & if in case my Wife should happen to Marry I give unto my said daughter Alida my Beadstead with the Bed Bedding & appurtences thereunto belonging.

Item, I give unto my son John Van Schaick my silver watch & when he come to the age of twenty years my Negro name Gett. Item, I give unto my son Sybrant Van Schaick my silver hilted sword & when he comes to the age of twenty years my Negro boy named Jack. Item, I give unto my son Tobias Van Schaick a pr pistols & silver spurs & when he come to the age of twenty years my Negro boy named Claus.

Item, I give unto my son Myndert Van Schaick a gold ring a pair of Gold Slave buttons & Silver buckles of every kind & when he comes to the age of twenty years my Negro boy named Pet.

Item, I will that my wife with the advice of my Executors shall set apart so much of my personal Estate for my son Abraham Van Schaick as they shall think necessary to make him equal in Inheritance in personal Effects with either of my four sons above mentioned:

Item, I will that my wife if she remains my widow shall have the disposal & income of the before mentioned until my sons severally come to the age of twenty years.

Item, In case my Wife [passage missing from transcription] divided between my six children, Alida, John, Sybrant, Tobias, Myndert & Abraham share & share alike & what than remains of my personal Estate & is not herein otherwise disposed of be equally divided between my wife & my six children share and share alike if in case any of my children should happen to Die without lawful Issue before they can inherit any part of my Estate I will that there share or proportion of my estate shall be equally divided between the survivors.

Item, I do hereby give full power to my wife during the time of her Widowhood together with my herein after name Executors to enter into any Lawsuits either for the maintenance or recovery of my Real Estate & that my proportion of the costs attending the same be paid out of my personal Estate also full power to sell part or all of my Landed Estate as they judge best for the Interest of my family likewise full power to my Executors to give up if they think best part of my landed Estate for to accommodate or settle any disputes or Lawsuits that may hereafter arise concerning the same

Lastly I appoint my well beloved Wife Maria Van Schaick together with my trusty and good friends Henry Quackenbush of the Colony of Rensselaer Wyck & John Roseboom of Schenectady Executors of this my last will & Testament. In Testimony whereof I have hereunto set my Hand & Seal in Albany the day & year above written.
