Will of Jacobus Van Valkenburgh - 1766


In the Name of God, Amen

I Jacobus Van Valkenburg of the City of Albany in the Province of New York, Carpenter, Considering the uncertainty of this Mortal Life, and being of sound and perfect Mind and Memory Blessed be Almighty GOD, for the same. Do make and Publish this my Last Will and Testament, in Manner and Form following that is to say.

FIRST I give and bequeath unto my son Isaac Van Valkenburg and to his heirs the Sum of Ten Shillings Currant Mony of the Province, for his Right of Primogenature, and as a Barr to his pretension of being my Heir at Law,

ITEM I give devise and bequeath unto my beloved Wife Margaret Van Valkenburg, all and singular my whole Estate, both Real and Personal, of what name or Nature forever, to be by her Disposed of, according to Her will and Pleasure in all Things, TO HAVE AND HOLD my said whole Estate both Real and Personal, of what Name or Nature forever, to Her my said wife Margaret Van Valkenburgh and to her Heirs and Assigns for ever

And lastly I do herby Constitute and appoint my said beloved wife Margaret Van Valkenburgh sole executrix of this my last Will & Testament, hereby revoking all former Wills and Testaments by me in anywise made. IN WITNESS whereof I give hereunto set my hand and affixed my Seal; this First Day of September in the Sixth Year of the Reign of our Sovereign Lord GEORGE the Third by the Grace of GOD, over GREAT BRITAIN, FRANCE and IRELAND King, Defender of the Faith &c and in the Year of our LORD, One Thousand, Seven Hundred and SixtySix.

The above named Jacobus Van Valkenburg to be His Last Will and Testament, in the Presence Of us who have hereunto Subscribed our Names As Witnesses in the Province of the Testator

Be it remembered that on the third and twentyninth days of March in the year of our lord one thousand seven hundred and ninety two personally appeared before me Abraham G. Lansing Esquire Surrogate of the County, John Roorbach and Staats van Santvoort two of the witnesses to the within will – who being respectively duly sworn on their oaths declared that they did see Jacobus Van Valkenburgh of the said city deceased sign and seal the within written instrument purporting to be the last will and testament of the said deceased and that they afterwards hear him publish and declare the same as and for his last will and testament that at the time thereof the said Jacobus Van Valkenburgh was of sound disposing m[ind] and memory to the best knowledge and belief of thes[e] deponents the their names subscribed to the said will are respectively of their own proper names [ ]ting and that they did see Thomas L Witbeck the o[ther] witness thereto subscribe his name in the presence [of] the testator. Be it also remembered that on the thirteenth day of March in the year last above written Abraham Bloodgood of the City of Albany likewise appeared before me and entered into Bond and was duly sworn to the faithful performance of the above written will as administrator with the will annexed the executrix therein na[ ] having departed this Life. City and County of Albany ss. Be it remembered that on the third and twelfth days of March one thousand seven hundred and ninety two personally appeared before me Abraham G. Lansing Esquires Surrogate of the said County – John Roorbach and Archibald Campbell who being respectively duly sworn on their oaths declared that they respectively did see Margaret Van Valkenburgh late widow and relect of Jacobus Van Valkenburgh of the city of Albany aforesaid deceased sign and seal the instrument wrote on this sheet of paper purporting to be the last will and testament of the said Margaret Van Valkenburgh and heard her afterwards publish and declare the same as and for her last will and testament, that at the time thereof the said Margaret Van Valkenburgh was of sound disposing mind and memory it is our knowledge and belief of these deponents and of their own proper hand writing and that they did also see William Pemberton the other witness thereto subscribe his name in the presence of the testatrix.

Be it also remembered that on the second day of April in the year last above named Abraham Bloodgood of the City of Albany aforesaid appeared before me and entered into bond and was duly sworn to the faithful performance and execution of the said will by taking the usual oath in that case – provided the Executors therein named having renounced their executorships and refused to be concerned therein.
